Hello All, My H1B is still pending with USCIS and I am currently on F-2. Recently, my spouse had her TPS approved. She is maintaining F1 to keep my status. My question - should I apply for TPS too or wait for H1B result? Your suggestions are valuable...

@Unicornis, Yes, it is always good to apply TPS, there is no harm for H1B, and you are still waiting your H1B result, looks you got RFE. It will be safe, by the way, how long did it took your spouse to get TPS approved after fingerprint date. I am waiting for TPS and it's been 6 weeks after fingerprint and no response.

Then you should be fine. You can apply TPS too but not necessary. But to be in status u might need to maintain valid cap gap i20..

@Problem, Yes, I got RFE on July 26th and the company promptly responded on August 19th. USCIS updated status on Aug 26th. Company is American owned with solid reputation in map making arena. And I too have solid experience in map making using two software and this company use only one. So, they can use me. My spouse applied on July 9th but the application came back citing wrong fees. So, we applied again with correct fees around second week of July. She had her biometric done on Aug 25th. She got approval notice on Sept 21 and EAD hard copy on Sept 28. We just applied for SS which she will get within 7- 10 days. She is still waiting on travel document which they say, it is issued in rare cases only. Question: I have a misdemeanor, which is holding me back to apply for TPS. Will it be a problem? Question: If H1B gets approved, which status I will be on - H1B or TPS? Thanks for your input.

@unicorn, looks you are in GIS/GPS/RS field, making maps, where do you work for Garmin, Google, I am also in same field, map making. what software do you use?

@Problem I haven't started working yet (waiting patiently for H1B) but took classes and trained in AutoCAD - this is what the company use 90% of time. It is a land surveying company. The other software is ArcGIS Suite with ArcGIS Pro. I am to build a separate GIS department in near future if all goes well.. With TPS, I could work and the company would sponsor for GC. Feeling reluctant to apply for TPS due to misdemeanor...any suggestion would be useful.
