I have bachelor degree in MIS and have 2 yrs work experience too. My employer is willing to file for PERM (GC) under EB3(E) category. I wanted to know how long is wait time to get to Green card as of now including all steps. I really appreciate any detail information regarding this topic.

Thank you all in advance,

Step 1: Prevailing wage determination
Your lawyer will request the prevailing wage from Department of Labor. In other words, finding out what the salary is for your position in the area.
It takes anywhere from 30 days to 60 days (1-2 months)

Step 2:
Classified advertisement in the newspaper and other websites to prove that there're no qualified americans for your job which takes about 2 months then filing PERM (about 6 months-12 months)

Timeline: Anywhere from 3 months to 6 months, if there's audit 6-12 months.

Step 3:

Filing I-140 by employer. It can be done premium which takes 15 days, regular process can take from 2-3 months.

Step 4:
Waiting for your Priority date to be current to file Adjustment of status (I-485), last stage. Since you're EB3, check the visa bulltein by USCIS regulary. Right now the cut-off time is 22 Jul 2006 for Rest of the world (ROW). So the wait time is around 6 Years.

So if it stays the same way, you'll get your Green Card in : 2019 !

Good Luck.

Suggestion: Better to do your Master's then file under Eb2 which is lot faster even though the cut-off date for Eb2 shows 01 jan 2009, it will most likely be current after October 1 ,2012

http://www.travel.state.gov/visa/bulletin/bulletin_5733.html

According to the latest visa bulletin of July 2012,  ROW (nepal)  EB3 is current of 22 july 2006 i.e. people having priority date (the day when ur labor is filled)  on or before that can apply for 485 (adjustment of status or green card). SO basically its 6yrs backlog. People applying in 2006 are being greened now. When u apply in 2012 then above fact says that u will get it around 2018. but if you r lucky enough and there was not much application during the recession time of 2008 and 2009 then u can get early as well but that's just the guess, u cannot be sure on that.

Or the other way is, u can apply now and then may be do a masters in 2 yrs  then u can use the priority date of EB3 and do Porting to EB2 after which u have fairly good chances of getting  GC one year following that.

The next option is, you can apply now, then if u were not able to get it with in the next 3 years then u will have 5yrs of experience by that time, which makes u eligible to Port your EB3 priority date to EB2 (Bachelor+5 yrs), which again can get you GC with in 1 yr.

In my opinion, its better to go ahead and file for it, even if its the long wait coz if u can continue ur studies or have more experience then the priority date of now can always be used in future even if u port to different category and make it fast.

The decision is all yours, i m just showing u the options, afterall you r the master of ur world, GOOD LUCK!!!
