-2-3 months to get through all the processes before labor certification -max. 11 months to get through labor -1-3 months to get GC
It's always good to use your company's lawyer rather hiring the lawyer outside. But my company doesn't have any

I am not sure but if you have master degree in management and you are working in the area that required minimum master degree and salary restriction than you are qualified for EB2 as tole to me by one of my friend. Well I am just fresh graduate so don't know much. Correct me If I am wrong. MN

salary has to be above the prevailing wages but not at this time, company needs to promise to pay that salary after you get the GC

Either Equal to or above prevailing Wage Rate..Employment based GC is based upon the Future Job Notion.

Thanks for your information. Seems you have good knowledge. Can you share some with me too. Well I got my H1b approved, but still I am in OPT and my H1b will start in December as written in the paper send by USCIS. So do I need to wait till december for applying my green card or I can start process now?. As quoted by danphe do you think I will be able to get green card in a year.
Thanks M.N

I got my H1b started this year and planning to file for the green card too. The lawyer that I came across are charging too much. If you do come thru a lawyer that is reasonable please do let me know.

Missingnepal,
Technically there is no Correlation between the H1b and GC Process..You can File GC Right away as long as Meet the requirements in Employment based Criteria(EB1,EB2 or EB3)..You don't have to Wait till december to File for GC(That's when your H1b Kicks off). It's always better to file GC at earilest and as long as you can maintain valid status during the GC Process..
It really depends upon which Employment Category u r Filing GC..And let me Reiterate this once again "Simply having Master's degree in a particluar field doesn't mean that u can File GC on EB2. ..It's the nature of the Job that determines whether u are eligible for Eb2"
The Biggest Problem these days is the Labor processing(PERM)..Couple of Days back i found that DOL is processing the Labor for People that have Filed in Nov 2008.Appears as if there is Backlog in Labor..
On the Best case it will take a week to Approve the Labor and on Worst case it will take 8-11 Months to Clear it..I-140 for EB2 normally takes 2-4 Months to get Approved and I-485 takes again 1-4 months to Get cleared....Check to see if you can File Premium Processing for I-140..Will clear in 1 month if there is no RFE..
On the best case i have seen PPL getting GC in 4- 6 months after Filing labor..On the Worst case it won't take More than a year and half if there are NO RFE's in the Case....
Give and Take I agree withe Danphe's Timeline..
It's always Better to File GC on EB2 as the PD is Current for Nepal..
Hope it Helps..

Thanks Everyone,
I just need some information .
As i am working for state, my current job description requires only bachelors. And i believe most of the job in IT only requires bachelors degree only. May be there are hardly few jobs that specifically says, you need masters. So, how most of the guys addreshing this perticular requirement for EB2. Is there any work around. How these desi consulting are handeling this. Any info is appreciated.
