hi all,

I came to USA in j-1 visa with 2-year residency in Nepal. Is it possible to waive? If yes, how can i proceed? Please, let me know if you have any experience. Thanks in advance.

Complete Online DS-3035 Application: Complete and print your J Waiver Visa Recommendation Application (DS-3035) online. NOTE: This Online DS-3035 is now the
only acceptable version.

4. If you are subject to the INA 212(e) and want a waiver of the two-year foreign residence requirement, there are FIVE GROUNDS
FOR WAIVERS.
* No Objection Statement (NOS)
* Request by an interested government agency (IGA)
* Persecution
* Exceptional hardship to a United States citizen (or legal permanent resident) spouse or child of an exchange visitor
* Request by a designated State Department of Public Health or its equivalent, CONRAD

haruwa,

         I really appreciate your reply. Where did you find those 5 points? Is it from given website above? In my case, i guess a way to waive is using 1st point (NOS). Is NOS from Nepalese embassy or Ministry of Education in Nepal? If other friends have any idea, please let me know. Thank you.

@trouble- I don't have any personal experience or insight in this matter. I just looked it up. The 5 points are from http://travel.state.gov/visa/temp/info/info_1288.html.

* No Objection Statement (NOS):

The EV's home country government issue a No Objection Statement (NOS) through its Embassy in Washington, DC directly to the Waiver Review Division that it has no objection to the EV not returning to the home country to satisfy the INA 212(e) two-year foreign residence requirement and does not object to the possibility of the EV becoming a resident of the U.S. The NOS may also be issued by a designated ministry of the EV's home government and forwarded to the U.S. Chief of Mission, Consular Section, within that country to be forwarded directly to the Waiver Review Division. The EV has the responsibility for obtaining a no objection statement from his/her home government.
