Currently i am in H1B. I have been in H1 since june of last year. Prior to that I was a student and was working as a graduate assistance. Now obviously i have 2 W-2 forms but and my states has chanced from F-1 to H1b. To my understanding there are different Tax form for these states.
Now my questions are:
1. Do I have to file 2 diff. tax form? if yes, what are they called?

I know this a common situation that we go through once, if graduated from US university. Also Please fill free to out down yours experiance and suggestion.

Do you mean "states" or "status".

In any case, go to www.turbotax.com and try to file online. It is very very easy. They will charge only at the end. But before that step, you can find out what you need to fill out.

Otherwise, if you mean "states", then YES, you need to fill out state tax forms for both states depending upon how many days you stayed in a particular state.
If you mean "status", then there is no sepatate tax form for H1B and F1.

To my understanding if you are in F1 status you file Form 1040NR and if you are in H1B then you file 1040.
Doesnt that mean that i have to file 2 diff. form?

Don't know which one but one thing is for sure-> you have to file just one. 1040 or 1040NR.

I was also in OPT until Last October. Then after I was in H1B. I filed 1040NR until last year. I am wondering which should I file this year - 1040 or 1040NR.
The deduction amount we get in 1040 and 1040NR are different. Also I am plannig to apply for Green Card this year....Will USCIS ask for tax filed docs?

File 1040 NR.
Law requires any non-immigrant working in US (i.e., authoriazed work in F1 or H1 status) to file 1040 NR. By filing 1040NR, you will lose regular standard deduction provided in 1040 but you will be able to get your Social security and medicare tax.
Consult a good tax preparer.... Tax software are not made for special situation like yours nor local H & R block. So, consult a good tax preparer who knows what he is doing.

In second thought,

If you want to do everything lgally, file 1040 NR. If you have worked illegally or don't care, file 1040 and get regular deductions like US citizens or GC holders.

Kalimati,

If you are in US from last 5 years. Then you are considered as resident for tax purposes.
you are eligible to file 1040EZ. Don't file 1040NR(non resident) because your refund will be less.
Plus if you are in H1 for more than 183. U can file regular 1040( A or EZ).
You can look at the publication at IRS site regarding all the information.
I did look at both form last year and got $1000 more by filing 1040EZ instead of 1040NR.
Also you will get more form state tax too because you have to enter amount computed at Federal form.

Here is a reference, which i looked at last here for last two years form University of Texas.

Most of us don't that every international student should file form 8843 whether or not you work...

Thanks Himalayandude,
This is my situation. I have been in america for more then 5 years however i have been in H1-B status for less then 183 days. Previously I beleived i filed 1040EZ(for many diff. reasons).
On some websites I even found that there is something called duel filling in which people file both 1040 and 1040NR. I have no idea what that is?
Also,
Regarding state tax, My employer is in texas and my address is also shown as texas aswell(there is no state tax, and no state tax was deducted) . However I was a contractor worker So i worked on different states. Now how do i go about the filling the state tax. Do I have to file state tax for each state i have worked at?

If i was you. I would not pay tax for any other state but will maintain permanent address at Texas and put that address in pay stub and w2 forever.

IRS doesn't audit small fish like us but once IRS is behind your back, it will hunt you down no matter where you are.
